The SRG examines any scientific question relating to the application of the Regulations, but in particular Articles 4.1(a), 4.2(a) and 4.6 of (EC) No. 338/97. Where it considers that imports of a particular species from a particular country do not comply with the conservation requirements of the Regulation, the SRG may form a ‘negative opinion’, which indicates that the import of a particular species from a particular country and particular source should not be permitted. The opinions of the SRG should be followed by individual Member States. Once a negative opinion is formed, the Commission consults the range State to obtain further information on their non-detriment finding. If no evidence to overturn a negative opinion is identified, the negative opinion will usually be formalised in a legally binding Regulation that suspends trade in species under particular circumstances, known as the ‘Suspension Regulation’.
